What I know based upon what we know at this moment in time. Judge’s don’t actually have a time limit for making decisions in a civil matter. Decisions can be made at any time. We believe the judge will make a decision as quickly as possible because she certainly knows of the TRO and asset freeze and the impact it has on me and everyone else. Historically civil cases have taken several months to years, but of course we’re hopeful to see this resolve sooner rather than later.
We also know based upon fact of legal definition, which our Attorneys have done a fantastic job in bringing to the judge’s attention, that there is no investment offered on Traffic Monsoon. I’m referring in terms of investment contracts under law. In other words, ultimately the SEC doesn’t have jurisdiction over this business and is overreaching. We’ve also well defined what a ponzi is, and point-by-point proven by legal definition that Traffic Monsoon is not a ponzi. Also we’ve illustrated there is more than enough money to pay everyone what they have already earned, and no need to generate more sales in order to meet current obligations in delivering services and paying people what they have earned.
We’ve shown the judge that the business model has been fully and completely represented to the customer, which explains to the customer what the offered services are, and to those who intend to earn money: how to earn, where the money comes from, tasks to perform, rates, and provides no guarantees of income. While surfing a qualifying number of pages in the traffic exchange does merit a reward for adpack buyers, we have shown that the rewards are always limited by actual sales revenues the company already has in hand prior to issuing any reward for surfing in the traffic exchange.
Some have wondered why, then, is the judge taking so long to make a decision on this case when it’s so obvious. I believe the answer is because the judge over our case is not assigned to our case alone. She has many different cases she’s responsible for. Multiple cases before ours, and multiple cases after ours. She’s likely got a stack of cases she’s working through in making decisions, while at the same time working through a busy schedule of being in court sitting on the bench as a judge for many other cases every day. We’re waiting in line for the judge to reach our case in her stack, and we hope she takes the necessary time to review the business and how it lines up with applicable law and make a decision after thoroughly weighing out the facts.
We also hope that she makes the decision based upon law rather than have this case move forward to a trial. We all want to see this resolve in the shortest amount of time as possible. The legal system within the USA is a slow moving process, but we’ll continue working through each step of the way towards a win.
I’ve posted many times about legal definitions of things, and shown some of the strong arguments we have in our favor. Please forward those things to people who have doubt. We have within us true winning potential, and the truth is on our side. How long this will take no one knows, but of course timing is not in our hands but in the hands of the judge and the processes in place in the court system.
